Please note, in the following Terms and Conditions: 

- 'Photographer' refers to Kate Stevenson Creative Photography

- 'Client' refers to you, the individual(s) entering into the following agreement

- 'Contract' refers to the agreement made between both parties in line with these terms and conditions.

The following confirms in writing the terms and conditions of the entire agreement made between the Photographer and the Client at the point of confirming a photo session booking.

No variation or modification of these terms and conditions shall be effective unless agreed upon by both parties in writing. 

Booking Fee & Session Payment

A fixed price of £150 is payable for the services of the Photographer. This includes booking fee, the cost of the session itself and the edited high resolution digital images delivered to the Client afterwards.

A booking fee of £30 secures the services of the Photographer for the date and time of the photo session and is payable immediately in order to confirm the booking. The booking fee is non-refundable in the event of cancellation.

The remaining balance of £120 (£150 session fee minus £30 booking fee) is payable after the photo session, before the edited high resolution digital images are delivered to the Client. The edited high resolution digital images will only be delivered to the Client once payment has been received in full and in cleared funds.

Additional Fees

The Photographer will meet the cost of travelling to any agreed location within a 30 mile radius of her home. Should the Client wish to select a location further afield, they accept that any additional distance travelled will be subject to a charge of 45p per mile. Any such additional travel costs will be added to the remaining session fee balance, payable as detailed above.

Images / Photographs

The Photographer cannot guarantee any specific poses, effects or backgrounds, but will produce photographs that timing, lighting, weather, location and participant co-operation permits. Although every effort will be made to meet Client requests and requirements, the Photographer shall be granted artistic license in relation to the poses and locations photographed.

Images are edited at the Photographer’s discretion. The edited high resolution digital images delivered to the Client will not include every image taken during the course of the photo session. The Photographer reserves the creative right to edit and release only those images deemed professional in quality and in keeping with the Photographer’s artistic standards.

Copyright

The 1988 Copyright Act assigns the copyright of all images to the Photographer. The Photographer continues to retain full copyright of all images at all times, unless there is specific written agreement to the contrary.

The Client agrees that they will not - under any circumstance - alter, edit or manipulate any of the Photographer’s images and understands that doing so would constitute a breach of copyright.

The Photographer reserves the right to use images created under this agreement for advertising, display, publication or other purposes.

Insurance & Liability

The photographer will maintain Public Liability and Professional Indemnity Insurance at all times.

The Client expressly releases the Photographer from all claims, damages, and liabilities that may result from accidents or incidents that occur while services are being performed or thereafter. This waiver of liability includes waiver of any claim that may be a result of negligence.

In the unlikely event of a total photographic failure, loss or damage of photographic materials, or cancellation of this contract by either party in any other circumstance, the liability of one party to the other shall be limited to the total value of the contract. The Photographer will return the full session fee to the Client. 

Neither party shall be liable for any indirect or consequential loss of photographic materials.

Force Majeure / Act of God

The contract is subject to alteration or cancellation by either party due to any cause beyond their control.

Cancellation

The Client may choose to cancel the photo session at any time by providing the Photographer with a minimum of three days written notice via email. 

Where a photo session is cancelled at short notice due to Client illness or circumstances beyond the Client's control, every effort will be made to rearrange the session for another convenient date and time.

Should the Photographer need to cancel the photo session due to circumstances beyond their control, every effort will be made to rearrange the session for another convenient date and time. If this is not possible, the Client's booking fee will be reimbursed.
